Thomas P. Krzeminski

Tom Krzeminski is a first-chair trial attorney with over 20 years of experience litigating complex patent and trade secret cases in federal courts across the country.

Tom has substantial expertise representing pharmaceutical clients in Hatch-Waxman litigation, often on the generic side. He has represented some of the largest generic companies in the world, as well as smaller niche generics seeking to launch their first commercial product. Tom is viewed by his clients and peers as an expert in Hatch-Waxman litigation, resulting in him being named a speaker at ACI’s annual Paragraph IV Disputes Conference in New York City on multiple occasions. Recognizing that a winning patent litigation strategy is only part of the gameplan, Tom also helps his clients navigate the Food and Drug Administration’s (FDA) complex regulatory framework to secure FDA approval for traditional Abbreviated New Drug Applications (ANDAs) and for 505(b)(2) New Drug Applications. Tom prides himself on helping his pharmaceutical clients win not only in court but also at the FDA, as both venues are critical to a successful generic launch.

In addition to his Hatch-Waxman litigation practice, Tom has experience litigating patent and trade secret cases across many technologies, including automotive, computer software/source code, construction materials, electronics, home improvement materials, industrial chemicals, mechanical devices, recreational vehicles and semiconductors. Tom also has experience litigating Section 337 actions before the U.S. International Trade Commission (ITC) in Washington DC.

Tom is recognized by judges, clients and his adversaries for his impressive oral advocacy skills. Whether in the courtroom, deposition room or conference room, Tom excels when he has the floor and the stakes are high. A former Division I soccer goalkeeper and Junior Olympian in track & field, Tom embraced the spotlight from an early age and relished performing at his best under extreme pressure. Although his playing days are over, Tom continues to draw on his competitive fire and coolness under pressure to achieve outstanding results for his clients in “bet the company” litigation.

In addition to his strong oral advocacy skills, Tom is a skilled writer and has published several articles relating to developments in intellectual property law. In recognition of his contributions, the Los Angeles Daily Journal named him as its featured contributor in the field of Intellectual Property.

Before joining Maschoff Brennan, Tom was a litigation partner at another Southern California intellectual property firm. After law school, Tom served as a law clerk to the Honorable Ruggero J. Aldisert, Senior Judge for the U.S. Court of Appeals for the Third Circuit. In law school, Tom served as Editor-in-Chief of the law review and was a dean scholar.

Father to an 18-year-old son with autism, Tom is passionate about advocating for and supporting individuals on the autism spectrum and those facing other developmental challenges, and has greatly enjoyed coaching soccer and baseball teams for children with special needs.

Tom originally hails from Cherry Hill, NJ, and is an avid Philadelphia Eagles fan, but is willing to represent Dallas Cowboys fans in extraordinary circumstances.
